CORE MEMORIES
(Minnesota Governing Law)
1. Agreement to Terms
By booking and/or accepting delivery of sleepover tents, air mattresses, bedding, décor, and related supplies (“Equipment”), the Client agrees to all terms and conditions below on behalf of themselves and all participants, guests, and minors in attendance.
2. Assumption of Risk
Client understands that participation in sleepover activities involves inherent risks including, but not limited to: tripping, slipping, suffocation hazards, allergic reactions, and property damage. Client voluntarily assumes all risks, known and unknown, for themselves and all guests, including minors.
3. Release & Waiver of Liability
To the fullest extent permitted under Minnesota law, Client releases and holds harmless Core Memories, its owners, employees, contractors, and representatives from any and all claims, injuries, damages, losses, or liabilities, including but not limited to bodily injury, illness, death, or property damage, arising from or related to the use of the Equipment.
This waiver applies regardless of cause, including ordinary negligence.
4. Supervision of Minors
Client acknowledges that adult supervision is required at all times.
Core Memories does not provide supervision or childcare services and is not responsible for monitoring children during the event.
5. Proper Use of Equipment
Client agrees that:
- Tents are not to be climbed on, leaned against, or used for rough play
- No food, drinks, slime, makeup, nail polish, markers, candles, incense, or liquids inside tents
- No jumping, wrestling, or horseplay on air mattresses
- Equipment must be used indoors only, unless otherwise approved in writing
Failure to follow proper use guidelines may result in additional charges.
6. Illness & Hygiene Policy
Client agrees not to allow participation by any child who is sick, has lice, bed bugs, or any contagious condition. Violation may result in immediate cancellation without refund due to sanitation risks.
7. Damage, Loss & Replacement Responsibility
Client assumes full financial responsibility for any damage, staining, breakage, loss, theft, or misuse of Equipment during the rental period.
This includes but is not limited to:
- Tents
- Air mattresses
- Bedding (sheets, blankets, pillows)
- Decorative items, trays, lights, signs, or accessories
Client agrees to pay:
- Cleaning fees for stains or excessive soiling
- Repair costs where applicable
- Full replacement cost if an item is damaged beyond repair or missing
Charges may be applied to the card on file within 7 days of the event unless agreed upon otherwise.
8. Cancellation & Rescheduling Policy
If you need to cancel, it must be done 14 days prior to your event to receive a partial refund (50% of your party payment). If you're within 14 days of your booking, we can offer a reschedule date (within 1 year of your original scheduled date). If you have chosen a custom theme or custom add-ons, you will only have the option to reschedule your sleepover. If you cancel within 72 hours, you'll be required to pay for any add-ons that can't be held over until your future date (food, balloons, candy boxes). You will receive your refund within 7-10 business days.
9. Photography & Marketing
Unless Client opts out in writing, Client grants permission for non-identifying photos of setups to be used for marketing purposes.
10. Indemnification
Client agrees to indemnify and defend Core Memories against any claims, lawsuits, damages, or expenses arising from Client’s event, guests, or misuse of Equipment.
11. Governing Law & Venue
This Agreement shall be governed by the laws of the State of Minnesota, and any disputes shall be resolved exclusively in Minnesota courts.
12. Entire Agreement
These Terms & Conditions constitute the entire agreement between Client and Core Memories. No verbal agreements shall modify these terms.
